HEALTH GUARANTEE & SALES CONTRACT
In order for us to honor our sales/health guarantee, we require ALL adopters to have or obtain PET Insurance. Contract is binding once a deposit has been placed towards a puppy
We send all puppies home with complimentary 30 day Pet insurance through Trupanion, AFTER the 30 day trial period it will be up to you to keep that pet insurance OR you may obtain your own.
ALL PUPPIES PURCHASED AS “PETS” ARE REQUIRED TO GO HOME FULLY VETTED ( UNLESS OTHER ARRANGMENTS WERE MADE )
PLEASE UNDERSTAND NOT all Pets are Breeding quality & should NOT be bred, we do charge a DEPOSIT for puppies going under spay/neuter contracts
EVERY BREEDER HAS THEIR OWN POLICY & PRACTICES SO PLEASE BE RESPECTFUL OF OURS =)
*WE REFUSE THE RIGHT TO SELL ANY PUPPY AT ANY GIVEN TIME TO ANYONE PERIOD
UNDER NO CIRCUMSTANCE CAN THE PUPPY BE USED FOR BREEDING, UNLESS FULL BREEDING RIGHTS ARE PURCHASED,
To secure and to ensure lineage, pedigree and quality of my puppies, I do not tolerate ANY breaching of this contract, if breeding rights were not purchased, ALL puppies are required to LEAVE spayed/neutered OR UNDER A STRICT SPAY & NEUTER CONTRACT IF WE CHOOSE TO DO SO. Breaching of any portion of our contract will result in legal action against the buyer, as well as associated court/attorney fees, fines, and the surrender of the puppy.
All Payments/deposits placed are non refundable and held for liquidation purposes in the even mind is ever changed
24- Month Health Guarantee
Although we do several types of health testings on our dogs, things can always happen out of our control, so please understand situations can occur, health testing lessons the chance of offspring having genetic disorders
This 24 Month Genetic Health Guarantee Applies only for 24 months from the date of birth of the puppy AGAINST any Genetic issue that is considered a life threatening genetic health issue that will cause death( INCURABLE/UNTREATABLE )
**PUPPY MUST BE SURRENDERED BACK TO BREEDER FOR FULL REFUND/OR REPLACEMENT - FAILURE TO SURRENDER OR RETURN PUPPY BACK FORFEITS THIS HEALTH GUARANTEE NO EXCEPTIONS** IF ADOPTER CHOOSES TO KEEP THE PUPPY KNOWING A CERTIFIED VET HAS DEAMED A LIFE THREATENING GENETIC DISORDER, ADOPTER ASSUMES ALL LIABILITY AND FUTURE COSTS/VET EXPENSES AND ANY FUTURE OUT OF POCKET EXPENSES ASSOCIATED WITH THEIR DECISION TO KEEP THE PUPPY, BREEDER WILL OFFER A REFUND OF THE PUPPY PURCHASE PRICE ONLY IF THE PUPPY IS RETURNED BACK OR WILL OFFER TO REPLACE A PUPPY
1) Buyer understands and agrees to take this puppy to a Licensed Veterinarian at their own expense for a full check up.
2) Breeder does not guarantee against treatable nuisances such as , fleas, fungus, mites, giardia or coccidia etc, which are not life threatening but VERY common in pups NOR will breeder cover any other treatable issue that may arise that are NOT deemed life threatening
3) Under NO circumstances will this puppy be allowed to roam outdoors unsupervised, and Under NO circumstances will this puppy be chained or tethered, abused or mishandled in any way.
4) Under NO circumstances will this puppy or puppies from this dog be sold to or given to any pet shop, laboratory, or any similar facility.
5) Under NO circumstances will this puppy be bred, unless SOLD WITH BREEDING RIGHTS. BUYER AGREES AND UNDERSTANDS PUPPY WAS PURCHASED AS A PET ONLY & NOT ALL PET QUALITY PUPS ARE OF BREEDING QUALITY.
x. Obligation to Execute SpaySecure Agreement and Sterilize Pet.
Buyer acknowledges that a) a material condition of this sale and transfer of this
pet is that this pet is a non-breeding animal, and b) that the pet is being sold to
Buyer in reliance on Buyer’s compliance with the obligation to sterilize the pet
before the deadline set forth in their SpaySecure agreement. In so acknowledging,
Buyer agrees to sign and comply with all terms of the SpaySecure sterilization
agreement, to not breed the pet, and to take the pet to a licensed veterinarian and
have it surgically sterilized before the specific deadline set forth in their
SpaySecure sterilization agreement.
6) If this PUPPY is found to be neglected or of ill health for an unreasonable length of time, Or Bred without permission, Then purchaser will surrender the PUPPY to the seller unconditionally WITHOUT A REFUND.
7) Unless purchased with papers and or breeding rights, buyer agrees that puppy is placed fully vetted, & cost is covered and included in pricing, unless other arrangements were made this is UPON Our discretion if we choose to place under spay/neuter contract
8)Buyer agrees that the Puppy/Dog purchased as a pet ( OR with breeding rights) Can NOT/Never be resold Or Given to anyone else, If it is found that the puppy was sold/rehomed with out the breeders consent legal action will be taken.
9)) If for any reason the purchaser can not keep the PUPPY for any reason, the PUPPY must be returned back to the BREEDER/Seller. Breeder/Seller will try to place/re-home the PUPPY for the purchaser, no refunds are given / Depending upon the circumstances ( breeder discretion) Breeder may grant A PARTIAL Refund. If the puppy is NOT returned back to the breeder Or is re-homed/RESOLD with out the consent of the breeder Legal Action can be taken.
10) We feel it is important to isolate your new PUPPY for a few days to a week and give it time to adjust to the new environment before introducing other pets; and to imprint where his/her BED will be kept, ideally
11) Purchaser assumes full responsibility for this PUPPY upon leaving seller’s premises, BREEDER/SELLER IS NOT RESPONSIBLE FOR ANY VET COSTS/EXPENSES INCURRED BY PURCHASER.
12) Seller/Breeder is not responsible for any shipping fee(s) incurred for returned PUPPY(S) should a replacement be given.
13) Under NO circumstances will a cash refund be given at any point IF mind is changed on A puppy, we can transfer deposit over onto a future litter, OR OFFER A replacement if appropriate
The purchaser accepts full responsibility for this puppy and agrees to provide properly for its welfare. It is understood that this is a live animal and is not considered to be a perfect creature by any definitions. This puppy is warranted to be in good health to the best of the Breeder’s knowledge. If puppy is found to be medically deficient, with AN Un-treatable or life-threatening problem, such problem must be reported to SELLER/BREEDER immediately (within 48 hours of you receiving notice from your vet). If a Veterinarian certifies that your puppy is medically deficient with an untreatable condition, then your puppy MUST be returned to SELLER/BREEDER IMMEDIATELY, with written documentation from your licensed vet. Puppy MUST Be returned back within 3 days of diagnosis, FAILURE TO SURRENDER/RETURN BACK The Puppy Voids any Health Guarantee/Warranty & BUYER forfeits any future replacements, and refunds, and any and all payments made will NOT BE REFUNDABLE in the event the puppy is not returned back to the breeder. Breeder will NOT be responsible for any vet bills/out of pocket expenses if the puppy is not returned back to the breeder, if adopter declines to return the puppy back they assume full responsibility and adopter will be responsible with any and all costs associated with keeping the puppy
If puppy should die from a genetic defect within 24 months from the date of birth of puppy. Breeder will replace with a puppy that Seller/Breeder deems to be of equal value and quality as soon as one becomes available, but only with a proper veterinarian written report. A written detailed necropsy report from a licensed vet as proof of death from a defect will be required to be provided by the Purchaser to the Breeder, at Purchaser’s cost. The seller is not responsible for any costs incurred in maintaining the health of the puppy. This is excluding all minor problems that could occur from the stress of the trip.
- This 24 Month health guarantee will be void if PURCHASER has not kept up with puppy(s) regular upkeep including and not limited to , required vet check ups, age appropriate shots/screenings, proper grooming and ear maintenance. All puppies will be required to have had all age appropriate vaccinations and preventative worming(s), documentation from your licensed vet will be required as proof that all noted has been in compliance before any replacement is made of puppy, should it be returned back due to a life threatening illness that is NOT curable or treatable, IF Puppy is NOT returned back to the breeder, The BUYER then forfeits ANY Future replacements, NO legal action can be taken against breeder, Buyer assumes ALL future costs associated with , vet care, medical expenses and diagnosis.
- Seller/breeder is NOT Responsible for any type(s) of Parasites or Common disease(s) that are deemed curable OR that are treatable with medications per a licensed vet. Breeder/Seller is NOT Responsible for any Minor Umbilical Hernias-
WE will never Knowingly place or re-home any puppy that is deemed not healthy
( By placing a Deposit to reserve, THIS is a Mutual Agreement of this Policy between Buyer & Breeder)
Breeder Can Opt to take Legal action IF ANY of Contract is Not Met, this contract IS Binding whether signed or not, BUYER Fully agrees to ALL conditions in this Health Contract/Guarantee
* PLEASE NOTE ALL PAYMENTS & DEPOSITS PLACED ARE NON REFUNDABLE BUT IF MIND IS CHANGED ON THE PUPPY DEPOSIT WAS PLACED ON, DEPOSITS CAN ALWAYS BE TRANSFERRED OVER TO NEXT LITTER IF NEEDED *
ALL DEPOSITS/PAYMENTS PLACED ARE NON-REFUNDABLE, ALL DEPOSITS/PAYMENTS are Held and Retained for Liquidated Damages if buyer changes their mind, a lot of time is spent advertising and raising our fuzzies, and once a payment/deposit is received, your fuzzy is reserved and " deemed sold" once A DEPOSIT/PAYMENT is placed OTHER potential adopter's are turned away.
In the even that your Pup has been deemed by a licensed vet to have a life threatening genetic disorder within 2 years of purchase, A replacement PUPPY will be offered, the initial puppy is to be returned/surrendered back, SHOULD There be a Medical deficiency that is NOT curable Or Treatable, We will offer a replacement puppy.
IF the replacement puppy is declined by the BUYER then buyer forfeits any future replacements, and any and all payments made will NOT BE REFUNDABLE. If Buyer refuses to return back/surrender pup buyer then forfeits any future replacements, and any and all payments made will NOT BE REFUNDABLE, No legal action shall be taken and BUYER assumes ALL RESPONSIBILITY and any and all future COSTS associated .
